Below you will find important information about My Cash Loanz and the service We provide. We request that you read the following terms and conditions prior to completing our application form to ensure that you are satisfied with the service we can offer you. If, after reading our terms and conditions, you do not agree with the content then we request that you do not use our service.

“Terms” means these terms and conditions; “Users” means the users of the Website collectively; “User Information” means the details provided by you on any application via the Website; “We/Us/Our” means My Cash Loanz; “Website” means the Website or any subsequent URL which may replace it which is used to access Our form; “You/Your/Customer” means a user of the Website. “Service” means the process in which My Cash Loanz matches your application with a Lender or Finance Provider. “Voyager” means My Cash Loanz. “Lender/Provider” means the third party company who may provide you with a loan or a Loan Brokerage service and or another financial service.

About My Cash Loanz

We provide our service to you and therefore have no obligation to any other party, only you. In the event of a third party using our service on your behalf, then our obligation will still be with you being our customer. The terms and conditions will relate to you, our customer, and not with any other third parties.

Our service

My Cash Loanz is owned and operated by My Cash Loanz.

We are not a Lender or Provider and do not provide any finance directly to You; We provide an online loan matching service, We will introduce You to Lenders or Providers of financial services. By submitting an application through Our Iframe form You will be giving Your consent for Voyager to match Your application with one of the Lenders or Providers on Our panel. We will present Your application in real time to one or more of Our Lenders or Providers based on their lending criteria until such time as one of Our Lenders or Providers accepts Your application or all Lenders and Providers decline Your application. If a Lender or Provider accepts Your application You will be forwarded to a page on the Lender or Provider’s Website that they have requested We direct You to or if the Lender or Provider does not work online We may present You with a screen that gives You information and contact details relating to the Lender or Provider that accepts You.

It is important to understand that We will only forward You to a Lender or Provider that has looked at Your application and accepted it as one they believe there is a good chance they can provide a loan or relevant services to You. It is also important to understand that We may be paid a fee by the Lender or Provider for introducing You to them.

There is no obligation for You to take up the loan or service you may be offered. You should read their conditions carefully and make a responsible decision on whether You believe their service is right for You. If You have any questions or are unsure You should contact the Lender or Provider before taking out any service or loan with them.

Any examples of amounts available to borrow, terms (repayment periods) or rates stated on the Lender or Provider Websites are purely given as a representative example relating to the product. These representative examples are stated to give You an understanding of the products available. Representative examples are not given as a figure of what You will actually be offered by the Lender/Finance Provider, therefore, cannot be given as a guarantee nor can they be used as any kind of warranty. As We do not provide the loan or financial service directly to You We are unable to control the representative rate examples contained on the Website. Please also be aware that the decision to offer any loan or financial service is made by the Lender or Finance Provider and We have no control over the decision making.

The Lender/Finance Provider will conduct an assessment on You before any decision or offer is made; this may include a full assessment of Your credit history both past and present.

Customer checks & referencing

Upon application the Lender or Finance Provider may use both fraud prevention and credit reference agencies to help make relevant decisions.

Credit checks and credit reference agencies can also help prevent fraudulent applications so We ask You to agree to use data provided for the purpose of preventing fraud and ensuring Your identity is protected.

Information provided by You must always be true and accurate, as misleading information will be regarded as a breach of Our terms and is likely to breach any agreement You have entered into with a Lender or Finance Provider. Misleading information may also result in the instigation of criminal procedures against You.

If You have authorised any third parties to act on Your behalf any information given by the 3rd party will be contractually binding on You. Should You choose to make a joint application for a loan or finance via the Website each party will be dealt with as a client acting with the consent of the other and if correspondence is entered into with one party of the joint application it shall be assumed that the communication is with both parties.

Information about You and visiting our website

We will only process information about You in accordance with the privacy policy.

When You use Our website and form You consent to us processing Your personal information and therefore warrant that all information/data provided by You is accurate and correct.

How your Personal Information is used

Information that is collected by us, My Cash Loanz, will be recorded electronically and may be used by us in the following ways:

  • To verify customer’s identity and credit standing and to enable us to consider and process your application for a loan or other products or services.
  • To assess your credit history and confirm your employment details.

  • To update this website to better meet our client’s needs in the future.
  • To help Voyager Limited to carry out admin and service your account.
  • As some of our affiliates who form part of our group are based outside of NZ then we may use your information outside NZ. If we do use your information outside NZ we ensure we have established levels of protection to ensure that your information is safeguarded.

Your data may be used for other purposes, including but not limited to, data validation, enhancement, information verification, identity verification, suppression, tracing and to the extent permitted by law, individual reference or look-up services, by selected 3rd parties.

Exclusions

The obligations and responsibilities of any breach of contract of or by us do not extend beyond the agreement with our customer and do not include any obligation to a counterparty, intermediary, bank or to any other third parties that may be connected to the customer. The customer will take full responsibility for any loss and or damage incurred by the provision of incorrect information or misleading information to us by the customer. Should the above occur and a loss arise due to us then there will be no liability held against us if this is caused by something beyond our reasonable control, including changes in the law or regulations affecting our normal operations. Apart from provisions expressly covering associate companies, nothing in these terms is enforceable by anyone who is not a party to them.

Viruses, hacking & other offenses

You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our website via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. Acknowledgement & Consent

I understand that by completing an application form that Cash Loans (the entity) will collect, use, hold and disclose my information as outlined in the Privacy Policy, which I declare that I have read and understood as it contains notifiable matters.

Collection of information

I consent to the entity collecting personal and credit information from me. I understand that if I do not provide all information that is requested from me the entity may be unable to provide me with their services. I also understand that if any of my personal information should change, such as residential address, phone number, email address, etc, it is my responsibility to advise the entity of this.

Use of information

I consent to the entity collecting my information for the purposes of providing me with referral and marketing services and any related purpose including but not limited to:

  • customer service requests such as providing access to and updating personal information and resolving disputes;
  • gathering information and statistical data to analyse and evaluate business functions;
  • complying with legal requirements under various acts such as the Consumer Guarantees ACT (CGA), the Privacy Act 1993 and the Anti-Money Laundering and Counter-Terrorism Financing Act 2009;
  • developing our service offerings and improving overall business processes and efficiency.

Disclosure of information

I consent to the entity disclosing my personal information to provide me with their referral and marketing services, and any other related purpose as outlined above, on an ongoing basis to:

  • credit providers, credit brokers, other referrers and other service providers.
  • the entity‘s auditors, contractors, agents, insurers, financiers and lawyers.
  • any other persons or entities who you have consented to.

I understand my information may also be disclosed in other circumstances outlined in the entity‘s privacy policy.

Exchange of Information with Other Providers

I understand that by providing my consent to exchange my information with credit providers, credit brokers, other referrers and other service providers, this information may be sold to them or disclosed for a fee. The amount of the fee would be determined on referral. I understand where my information is exchanged, it is being exchanged for any of the purposes for which I have consented to the entity, including offering me their products or services.

I understand that by providing my consent to exchange my information with credit providers, credit brokers, other referrers and other service providers, I am consenting to the entity exchanging all of my application information, such as my identification details, what type of loans I have, how much I have borrowed, whether I have met my loan payment obligations and if I have committed a serious credit infringement (for example, fraud).

Promotion of Products and Services

I consent to being contacted by the entity, and any external third parties or agents who act on their behalf, for the purposes of the promotion of products and services. I understand the entity may promote both their own products and services, as well as those of their marketing partners. I understand that I may withdraw my consent and request not to receive promotional communications at any time by contacting the entity.

Exchange of Information

I give my expressed and informed consent to the entity exchanging my personal and credit information with our financial platform partners.

I understand that by giving this consent, the entity may collect information about me from credit reporting bodies, such as bank financial information and credit reporting information.

Electronic Communications

I consent to receive all communications, information and documents, where possible, from the entity through electronic communications, including but not limited to:

  • requests for information regarding credit applications and contract variation requests;
  • disclosure documents such as credit guides and information statements, copy of assessments, credit contract documents, variations of these and credit contract offers;
  • notices, such as missed payment notices, default notices, final notices, settlement notices and account statements;
  • marketing materials and promotions;
  • any other communications, information, or documents that must or will be provided to you or which you have requested.

I understand that by giving consent to receiving electronic communications;

  • communications may be sent via any electronic means, such as SMS and email;
  • electronic communications must be regularly checked for communications, information and documents;
  • it is my responsibility to ensure the security of my electronic communications;
  • paper-based documents may no longer be given;
  • consent to the giving of documents by electronic communication may be withdrawn at any time.

Commercial Electronic Messages

I understand that under the Spam Act 2007, the entity may not communicate with me via commercial electronic messages unless I provide my consent. I consent to the entity communicating with me via commercial electronic messages (email, SMS, fax) to provide me with convenient and fast communications.

Electronic Bank Statement Retrieval

By making an application, I consent to the lender using on my behalf an electronic statement retrieval solution to collect my statements and information. (If you do not agree you should not use this service.)

I understand that one or all the following statements retrieval providers may be used;

  • Credit Sense (Privacy Policy: https://creditsense.com.au/privacy-policy.)

I understand that by using an electronic statement retrieval solution, such as those above:

  • I have read and agree to their User Terms & Conditions and Privacy Policies.
  • I understand I am using these services at my own risk.
  • I consent to them having read-only access to my bank account transaction data and for this data to be provided to the entity and any party I have consented to.
  • I understand that the transaction data supplied may include transactions from the previous 12 months from all available accounts.
  • I understand my user login credentials are encrypted and safely stored by a third-party service provider on their servers in a secure environment outside Australia.
  • I authorise the entity to use my encrypted login credentials in any future credit services and for the entity to request a read-only transaction history.

Declaration

I declare that I have read and understood this Acknowledgement and Consent document and that I acknowledge, authorise and consent to all the terms that it sets out.
